MACHJIVE
Hey guys and gals, I'm also pretty irritated that MachFive 2 is taking....well, literally YEARS to update. I was forced to buy a new Mac Intel machine, and now I can't use all my old samples/MachFive which I relied on for projects. That MOTU is taking so long is shameful.
READ THIS, MOTU:
This is NO way to treat your faithful customers. You seem like you completely disregard the needs of your customers in this -- abhorrent customer relations! The very least you could do is to have "update info" on your web pages about this, not make us all wait in the limbo lounge that this place has become (thanks to my other sit in friends here for making this so bearable).
Shame on you MOTU -- who ever is the boss of the company needs to learn a thing or two about corporate arrogance, and how that can destroy your company.....
I'm about to give up on MachFive, and find some other company to go with. Such a shame, since I shelled out way too much moola on the software. But MOTU is giving people -- professionals who live by making music -- no choice. That your host licensed software from Plugsound Pro has been out in the Intel version for a good time now only drives the point home.
Get wise, or you're customers will get wise on you, MOTU. We are all getting just a bit sick and tired of waiting....
(like anyone from MOTU ever reads these forums, right?)

Would they respond to someone who is going to be pissed off regardless
of Motus stance?..Likely not.
I to am a MachFive owner and getting a bit impatient as well.

Aw, c'mon guys; this is supposed to be a party.
Bitchin's been done to death, and doesn't make the wait any more pleasant.
Whilst it is bitchin', it's a sit-in, not a bitch-in!
Brilliant Chrissie card, Spike.

Pretend I've placed your favourite quote here
M5 Version 2
Companies make promises, just as individuals do. Following through is their responsibilty. I've worked for the company that manufactured some of the equipment you have listed and I've seen managerial decisions made on fixing a known problem by how many complaints were received regarding that specific issue. Only a few complaints, no fix.
The replies I've received from MOTU regarding the 2.0 update have not been straightforward and no confirmation that 2.0 will be Universal Binary despite a question on that part of the development scheme.
I was assured when I purchased the product that 2.0 was imminent. Directly stating the current status of the product after a long delay would seem to be appropriate. It's not a product in "super secret" deveopment.
As for the "party" you refer to..whatever.

Re: M5 Version 2
Remember folks... that in between the announcement at NAMM 05'and now, Motu has released Symphonic and Ethno... These are both products based on the UVI engine that runs MachFive... It does indeed seem that MachFive is seriously on the "back burner".garymadi wrote:"Companies make promises, just as individuals do. Following through is their responsibilty.

If it is to be developed at all...
It appears that recent sales of this product have been based on a promise or contract that the company has made to consumers which they have not honored in a timely manner. I believe that this is unconscionable and a breach of contract if I'm not mistaken.
When contracts are deemed unconscionable, or... not within reasonable expectations, the consumer has a right to demand a remedy...or a refund for any product purchased after such a public "contract" was made. Within a reasonable time period, of course. I believe that 2 years is within our reasonable expectations.
The 05' NAMM press release constitutes one of several contracts that MOTU made with the public and to its customers. Contracts which have been published in writing.
Other forms of this contract, such as its promise of a "Version 2 update later if you buy it now" may possibly constitute fraud on the part of MOTU if the contract is deemed unconsionable.
Maybe we need a class action lawsuit here to force MOTU to do what's right... pony up Version 2 of MachFive, or settle with claimants who feel that they've purchased MachFive Version 1 under false pretenses.
I say... we should stick our collective heads out of our windows and scream..."I'm mad as hell, and I'm not going to take it anymore"!!!
I think that this sit in should go to the next level... Who's for contacting the Better Business Beureau and filing complaints against MOTU. Who's for laying the groundwork for a lawsuit for "breech of contract and fraud" against MOTU.
This might be the just the remedy that MOTU needs to shake itself from its corporate laziness.
At least those folks who purchased MachFive under false pretenses an opportunity to get some $$$ back...
Lets take a poll...

I don't think James, this site's owner, is going to be too warm to associating Unicornation with a class action suit against MOTU. If you guys want to stage that, you'll probably have to do it elsewhere. Just a heads up.
Side note: Universal Soundbank, the company that provides all UVI apps to MOTU, still makes mention of MachFive 2 in their marketing media. I'm not sure what that means, but my hunch is M5 2 is not quite dead in water. Just hung up on some matter, perhap legal.

I DID TELL MOTU!!!
Well actually I did send an email to MOTU, and all I got back was a sort of standard reply about it being in process.
I suggested to them that they should, in the least, put a notice on their website updating all those who are waiting.....but no response on that!
No, corporate arrogance only gets you ditched in the end. Heads up MOTU, or your users will be bailing ship.
I for one wouldn't mind a full refund on buying MachFive now.... and if MOTU reads this, they need to sus up to the fact their users are getting mighty pissed off..... its just stupid. I mean, all they have to do is write a small notice on the progression......
Nuff of this sitting in line....I'm going home! Humph!

I don't have the time or resources to launch a class action suit for this...chrispick wrote:I don't think James, this site's owner, is going to be too warm to associating Unicornation with a class action suit against MOTU. But I think that what I've sited here IS basic contract law. MOTU has made a de-facto contract by making promises to update its product in lieu of immediate sales, and is therefore liable to make good on it's promises as per a published contract in a timely fashion.
I am bringing this up, say, as a heads up to MOTU. MOTU's actions are not the those of a responsible business entity.
Really, they should make this release a priority and stop dragging thier feet. If they don't want to create any more of these kinds of feelings from loyal clients, then make good on it.
At least putting a deadline or release date on it publicly would show good faith to the users like "garymadi" and myself. I for one am not ready to wait another year, if ever, for a good faith promise to be fulfilled.
Garymadi made a valid point when he said that following through on promises is a responsibility. I believe that anybody who purchased MachFive after the 05' NAMM press release has every right to be upset that this obligation has not been met after two years. And they have a legal right to demand it.

Then make contact with MOTU. Lodge your complaint to them directly.sunsinger wrote:I don't have the time or resources to launch a class action suit for this...chrispick wrote:I don't think James, this site's owner, is going to be too warm to associating Unicornation with a class action suit against MOTU. This site isn't owned by or associated with MOTU; it's run by an independent guy who just wants to give MOTU users a venue to help out each other.
I mean, if your time is so valuable and indignance so strong.
Otherwise, what can you hope will be done?
Been There... Done That...
You do not refute any of the valid arguments I am making.
MOTU should be a responsible corporate citizen. They aren't exhibiting this behavior.
I think that this forum is a perfect place to express the legal rights and ramifications that users should be aware of regarding this matter.
Besides, after 2 years, do you really think MOTU gives a d@mn... All of my attempts to discuss this subject with Magic Dave, both on the phone and on this forum have been Yadayadayada'd to death.

It's not my argument to take on. That's my point.sunsinger wrote:You do not refute any of the valid arguments I am making.
Well, you and I don't decide that. James does.I think that this forum is a perfect place to express the legal rights and ramifications that users should be aware of regarding this matter.
Look, if you want to keep posting what you're posting, go ahead. I don't make the rules. It's my observation, however, that posts like this test James' patience.
We'll see.
But mostly I just think you're venting instead of real solution-seeking. If that's the case, go at it, I guess.
