I notice that all of these are drives on USB external housings only and not the SSDs themselves,

Gonna venture a guess that the new housings for 2023, though not rectangular and boxy as the old ones not subject to the suit, have a heat dissipation problem.

There are designs from OWC and others that emphasize the heat sinks, cooling fins and the like. Heat has always been the enemy.
