logic w/ultralite won't allow 96 khz?

Lately I've done the firmware update.
I didn't check if it did happen before or not but now whenever I set up my motu audio setup at 96 khz and try to make a new project in logic 8 it'll automatically go back down to 44100 (showing this in audio setup, the moment it changes is after I load logic, when I put new project, or open an existing one)

Why would this happen now?
