These two quotes from Steve Oppenheimer's "First Take" article at the front of EM are interesting.
...we discovered that two major products were entering beta testing and both would be shipping at or near our newstand date. (emphasis mine)
The big breakthrough came when, after careful negotiations, both Digidesign and MOTU agreed to give us early beta copies of their new software samplers. We had to wait until the companies were confident that the betas were reasonably stable...
Is it time to start holding my breath yet?

Well, yeah - I don't have any sampler at all until it ships (OK - I've got the nano-sampler that comes with DP5 - but it seems kind of gimmicky).

Mach5 is the thing I'm waiting on to start this next project (and I want to retire a bunch of hardware drum boxes I've got laying around by sampling them).

A few things from the review that caught my attention:

1) Standalone
2) option for separate window for waveform editing
3) open formats directly w/o converting first

They're pretty old - not that many sounds to sample. :-) Perhaps a total of about 60.

Basically, the review appears to be a list of features and interface gadgets. Apparently, the reviewer spent little to no time actually loading and playing samples and I wonder if it was written from documentation of actually running the software?

No, you're wrong. James was referring to a specific, non-verified claim against a company, NOT legal issues in general. In fact, the instant discussion is so general and non-specific as to be innocuous. Search the forums for "legal" and you will find many posts. These are NOT what James was referring to in that single post you seem to be referring to.
