What do you pros think of Satriani vs Coldplay suit?
My first thought when hearing some of the comparisons on youtube like this one
http://www.youtube.com/watch?v=1ofFw9DK ... re=related
was - damn straight - nailed.
But it seems that particular phrase appears more than one might expect.
http://www.youtube.com/watch?v=6XnhFR73wOs
and
http://www.youtube.com/watch?v=G57CgtX-BsI (starts about 0:25 for the impatient)
FWIW, I think this is the best of the mashups.

To win a lawsuit Satriani must prove that Coldplay had access (actually heard) his song. This could be hard to prove as you can't throw a rock anywhere in the world without hitting someone who hasn't heard a Joe Satriani record.

Not sure how they can do that - it is snippets - not the complete work - should fall under fair use. I've heard longer "samples" in rap.James Steele wrote:Apparently video already pulled due to copyright claim by EMI Music.SixStringGeek wrote:My first thought when hearing some of the comparisons on youtube like this one

Joe is hurting for cash, and Coldplay isn't - and that's why there's a lawsuit.

That hasn't been true for many years.

Fair use doesn't apply unless the "snippets" are used for non-profit education, criticism such as a review or parody as long as it's a brief excerpt. Fair Use is narrowly defined in section 107 of the Copyright Law. Here is more info: http://www.copyright.gov/fls/fl102.htmlSixStringGeek wrote:Not sure how they can do that - it is snippets - not the complete work - should fall under fair use. From your link: >To prove copyright infringement, a plaintiff must establish (1) ownership of a valid copyright; (2) factual copying; and (3) substantial similarity<
I am not going to play amateur attorney here and I suggest that you follow my example. There are many cases of Copyright infringement on the books for your reading pleasure. You may draw your own conclusions.

You conveniently omitted the references to access in your excerpt, which definitely makes me "draw my own conclusions".mikehalloran wrote:From your link: >To prove copyright infringement, a plaintiff must establish (1) ownership of a valid copyright; (2) factual copying; and (3) substantial similarity<

You are correct. I will not play attorney. I had originally cited some links, thought better of it and deleted them. I have my reasons and will not post them online. If we ever meet in person, I'll explain over a beer - heck, I'll even buy.
All Copyright cases are subjective and open to interpretation. If you read enough case law, you will find that there are no hard and fast rules about infringement when the issue is similarity. Posting a link to one professor's paper isn't enough.
